CCTV privacy notification

This privacy notification explains how Hotel Co 51 B.V. and its subsidiaries (hereinafter referred to as “Hotel Co 51”, “we”, “us” or “our”) collects, processes, stores, transfers and deletes personal information through video surveillance (CCTV) at its various hotels.

Our purpose and legal basis

Hotel Co 51 is a hotel operations company that operates leading hotel brands under franchise agreements. While you, as our guest or visitor experience our service and hospitality we want to provide you and our employees all conditions for a safe and healthy environment. We also need to properly protect our properties and hotels.
For these reasons, we have a legitimate interest to use CCTV at our hotels:
• For the personal safety of staff, guests and other visitors;
• To act as a deterrent to prevent crime and protect our hotels and assets from damage;
• To protect guests’ belongings against damage and crime;
• To support law enforcement bodies in the prevention, detection and prosecution of crime.

We will not use CCTV footage for other purposes.

How long do we store the CCTV footage

In general, CCTV footage is stored for up to 72 hours, after which the information is overwritten or deleted. If local legislation sets out a shorter/longer retention period, that period will be applied. On occasions that the storage period is set beyond 72 hours, proper argumentation for the legitimacy of the purpose and the necessity of that longer storage will be provided, such as the investigation of an incident, or at the explicit request of investigating authorities like the police. If an incident is detected, footage related to the incident may be retained until the investigation or handling of the incident is completed.

CCTV footage is not transmissioned to third parties. Footage is only provided to public authorities on basis of a legal request provided by the appropriate investigating authority, such as the police.

Your rights and CCTV

We inform you of your rights with regard to your personal information and our use of CCTV:

Right to access information about how we process your personal information, including the categories of personal information we process, recipients of your personal information, and purposes for our processing.

Right to erasure (deletion) of personal information concerning you where: (a) the personal information is no longer necessary in relation to the purposes for which they were collected or otherwise processed; (b) you exercise your right to object and there are no compelling legitimate grounds for the processing; (c) the personal information has been unlawfully processed; or (d) the personal information has to be erased for compliance with a legal obligation applicable to us.

Right to restriction of processing (i.e., data will be blocked from normal processing but not erased) where: (a) you contest the accuracy of the personal information, for a period enabling us to verify the accuracy; (b) the processing is unlawful and you oppose the erasure of the personal information and request the restriction of their use instead; (c) we no longer need the personal information for the purposes of the processing but it is required by you for the establishment, exercise or defence of legal claims; (d) you exercise your right to object pending the verification whether our legitimate grounds override those of you.

Right to object to the processing of personal information based on our legitimate interests, provided that there are no compelling legitimate grounds for the processing that would override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.
